Casey’s Law
Casey’s Law allows a family member or friend to get someone in addiction into a court-ordered treatment program. The purpose of the law is to help adults who cannot see their own need for treatment due to their impairment. To use the law, someone (the filer) files a petition to have the person in concern be ordered to rehab.
Basically, this law allows a relative or friend to step in and help, because being sent to rehab is better than being sent to prison or dying of an overdose.
The Process
The first step is to approach the local courthouse seeking to file a petition. In this petition, the filer must be prepared to explain in detail why they believe their concern is valid. There is a fee to submit the petition, but there are resources available to help cover the fee (see below). If the petition is accepted, then the person in concern will need to see two medical professionals, with the help of the filer. Each medical professional will evaluate the patient to determine they are indeed suffering from Substance Abuse Disorder and need treatment.
After being evaluated medically, the person in concern will appear in court to determine the course of treatment. Treatment can last from 60 days to a full year.
